I don’t mean to post, yet again, another political topic, but had to respond to this one. Today, it is being reported that Obama was being unconstitutional when he appointed three members to the NLRB last year. Doing a little reading on what the NLRB are, they are an independent federal agency who investigates unfair labor practices.
Read, the full story here.
This is the kind of bullshit, I’m talking about, everyone, when it comes to, President Obama. It just proves how much of a scumbag and tyrant that Obama really is. He is nothing but a power hungry president who is not to be trusted.
Obama probably won’t get an impeachment over this, but he should since he was sworn in to defend the constitution earlier last Monday. Remember, you voted this man, people. He was unfaithful to the constitution on many other things. He needs to be exposed for Operation: Fast and Furious and Benghazi, as well.
Maybe the court ruling announcement will finally get the Obama supporters to realize what kind of man he really is. Probably not. They’ll just continue to kiss his ass and act like this is no big fuckin’ deal.
Kev
It’s not any big deal, Kev. Court rulings on the constitutionally of executive decisions happen in every administration
Of course, it’s a big deal, you disrespect the constitution, that’s not good in your part. This is gonna make the Obama administration look bad.
Kev
Obama was elected second term and he sworn in to defend the Constitution earlier this Monday, and he already broke it. I think that is worthy of an impeachment, in my opinion.
Kev
I knew you would say exactly that. You realize that rulings about the constitutionality of things the government does happen ALL the time? It’s not about disrespecting the constitution, it’s about one branch of government doing something that may be questionable only because the constitution is written in a way that allows vague things to be overruled or upheld. Relax.
It really isnt a big deal. The law is antiquted anyway, and when he made the appointment, it was more if a grey area than it was a violation.
The appointed was challenged and the court ruled. But its really not over yet as the White House filed an appeal with the Supreme Court.
If the WH wins the appeal, then nothing changes. If the WH loses the appwal, the worst that will happen is the positoon is vacated and a new appointment will have to be made.
Also, if the WH loses, Congress could still approve the appointment, and nothing will change.
It will be interesting to see how it all plays out, but there are no grounds here for impeachment, however it comes down.
Maybe not an impeachment, but he’ll get some punishment for it, though. Maybe a small fine, that’s about it.
Kev
No, he will not. I don’t think you understand the case at all.
This could be an impeachable offense, it’s all up to the court. Try to remember, this kind of reminds me of the Andrew Johnson impeachment. He was impeached as President ’cause he violated the Tenure of Office Act in which he can’t fire people but did anyway.
On top of this, Obama was unconstitutional on many other things from the past, not only this.
You guys need to get with it. This just proves that Obama is a liar and doesn’t give a rats ass about the Constitution. You say this is no big deal? I guess you don’t give a damn about the Constitution either.
Kev
You guys honestly believe this is no big deal for Obama, LOL? You think he’s going to walk away and act like this never happened? This is really bad for Obama and his administration. This destroyed him hard, what part of that you don’t get?
Kev
You may want to get some understanding and background on everything. Here’s a great article, that also clearly states that hundreds of appointments have been made like this my every modern president.
http://m.washingtonpost.com/politics/court-says-obama-exceeded-authority-in-making-appointments/2013/01/25/b7e1b692-6713-11e2-9e1b-07db1d2ccd5b_story.html
I’ve read that article, and yes, everyone else has probably sent appointments to the NLRB but they followed the Constitution. The reason Obama got busted for this was that he did it while the Senate was on break. You guys need to get with it. Obama is a horrible president, who just wants to ruin this country. THIS proves that Obama is a liar and you can’t trust him.
Kev
No, you DON’T get it, because the article is talking about all the other administrations that have done the exact. Same. Thing.
That is true that other presidents from the past has sent recess appointments, but I truly believe it’s all you guys who are the ones who don’t understand this case at all. From the Constitution itself, it states, “The President shall have Power to fill up all Vacancies that may happen during the Recess of the Senate, by granting Commissions which shall expire at the End of their next Session.”
I think what got Obama on this one was that he didn’t do this at the end of their session, but instead, he did it while they were on holiday. Big difference between holiday and “at the end of their session”. Obama did it whenever he wanted to and the Constitution didn’t allow that.
Kev
In other words, Obama abused his power pretty clearly in this one. If you can’t see that, then you’re dumb and ignorant.
Kev
1. Johnson was acquitted
2. The Supreme Court ruled that Tenure of Office Act of 1867 was invalid.
I don’t think Kev really knows what an impeachment is. I also don’t think he realizes this case isn’t something Obama is being prosecuted for.
I know what an impeachment is, “The President, Vice President, and all civil Officers of the United States shall be removed from Office on Impeachment for, and Conviction of, Treason, Bribery, or other High Crimes and Misdemeanors.” It’s all up to the House of Reps to whatever this falls under, they could have a look at this.
On top of that, if this won’t get Obama impeached, there’s a long list of other things that he needs to be impeached for.
Kev
Impeachment is basically an accusation and a proceeding. In an impeachment, both side get to present evidence and make their case. And then they await the ruling.
Much like “indictment” in the civilian world.
Sis you even read what you posted, Kev?
“The President shall have Power to fill up all Vacancies that may happen during the Recess of the Senate”
And this next paragraph is from the link YOU posted in your original blogpost:
Attorneys for the Obama administration argued that he had the authority because the Senate was away for the holidays on a 20-day recess. The Constitution allows for such appointments without Senate approval when Congress is in recess.
That’s according to the Obama administration. Doesn’t mean they’re right, though. They’re just trying to defend Obama’s rights, but truthfully, NONE of us understand (that includes me) this case. There’s gotta be something else in the Constitution that didn’t allow Obama to do this. Not what I just pointed out, something else.
Kev
I’m not the one having a hard time understanding it. Re read that section of the Constitution.
“The President shall have Power to fill up all Vacancies that may happen during the Recess of the Senate, by granting Commissions which shall expire at the End of their next Session.”
There is nothing granting Congress any power at the end of their session.
The recess appointments EXPIRE at the END of their ( CONGRESS’) NEXT session.
What I don’t understand is that every time Obama does something bad or violates the Constitution or whatever, the best defense that people can come up with is that Bush and other presidents did the same thing, they’re no different. *yawn* Lame. Can people come up with a better argument than that? It kind of shows they don’t understand what’s going on here.
People will also defend Obama and act like he’s innocent on everything. Please.
I’ll admit that I read the constitutional piece wrong a little bit but I was partly right that Obama felt like he had to sent recess appointments whenever he felt like it. If you want a better explanation on how Obama violated the Constitution on this one, check this article out:
http://online.wsj.com/article/SB10001424127887323539804578263793332301584.html
From the article:
“In the 46-page opinion, the three-judge panel said that “not only logic and language, but also constitutional history” reject the President’s afflatus. The Federalist Papers refer to recess appointments expiring at the end of the following session of Congress, the court explained, so it stands to reason that recess appointments were intended to be made only when the Senate is in a recess between sessions, not any time the Senators step out of the Capitol.
“An interpretation of ‘the Recess’ that permits the President to decide when the Senate is in recess would demolish the checks and balances inherent in the advice-and-consent requirement,” wrote Chief Judge David Sentelle for the court, “giving the President free rein to appoint his desired nominees at any time he pleases, whether that time be a weekend, lunch, or even when the Senate is in session and he is merely displeased with its inaction. This cannot be the law.”
So technically, Obama didn’t have the authority.
Kev
Yeah, no shit. What we’re saying is that 1. It wasn’t a crime and 2. It’s been a practice of every modern administration. That’s not saying that the judgment was incorrect, only that you’re railing against his administration for something that has been done hundreds of times before and isn’t an offense. It’s merely a court ruling on one particular instance for a practice that’s essentially status quo in Washington. So calm down.
Don’t be surprised if this goes on it’s way to the Supreme Court. Could be investigated even further.
Kev
It could fall under, “high crimes and misdemeanors”, “abuse of authority”:

Kev
You guys keep acting like what Obama did is no problem ’cause other presidents did the same thing. Of course, they all did, I’m sure. What you guys seem to not understand is that when Obama did this, the Senate was still technically in session. They may have been on a short holiday, but that didn’t mean their session was yet over. Just wanted to point that out, or you’re just going to keep saying that I’m wrong on everything and pretend that you’re right, all of the time like usual? You guys will never admit I do a good job on my politics discussion, will you? HA!
Kev
Final warning guys, I’m really thinking about closing comments for good ’cause all you seem to come here for is to attack and slam everything I say on here. You really are a bunch of idiot loser trolls who need to find a new obsession. The first negative response that comes from you, the comment will be deleted, and all of your comments will be sent to the spam folder so I don’t have to read ’em.
I may do my research on google and wiki, but at least I look up all of the right info, which I’m sure most of you guys won’t have the balls to do. It’s okay to do. I’m sure Howdy and the rest of you guys do the same exact thing, and I know you’ll never want to admit that either.
Really fuck off and find another blog to troll on.
Kev
Edit to add: Corrected comment for mistakes…
